Terms of Use

108 Pranayama · Effective 22 October 2026 · Version 2026-10-22

Please read these Terms carefully. They include a health and safety disclaimer (section 4), a limit on our liability (section 12), and, for people in the United States, an agreement to resolve disputes by individual arbitration and to give up class actions (section 15), which you can opt out of within 30 days. If you do not agree, please do not use 108 Pranayama.

1. Agreement to these Terms

108 Pranayama, including 108pranayama.com, the version you can add to your home screen, and all its features (together, the “Service”), is operated by Shri Anand LLC, 22 Robinson Road, Westford, MA 01886, United States (“we”, “us”, “our”).

By ticking the box on the welcome screen, or by using the Service, you agree to these Terms of Use and to our Privacy Policy, which explains how we handle your information. If you do not agree, you must not use the Service.

2. Who may use 108 Pranayama

You must be at least 18 years old and able to enter into a binding agreement where you live. By using the Service you confirm that you meet these requirements. You are responsible for your use of the Service and for keeping your own device secure, because your practice history and health information are stored on it.

3. What 108 Pranayama is

108 Pranayama offers tools for everyday wellbeing across mind, body, heart and finances, including Om Chanting, Digital Mala, Surya Namaskar guidance, My Sadhana, My Day, the Water Tracker with reminders, the Step Tracker, badges, and the Prana Plate, Mitra and Calorie Meter nutrition features. The Service is provided for general wellness, education and personal motivation only.

4. Health and safety disclaimer

The Service is not medical advice and is not a medical device. Nothing in the Service, including meal plans, calorie and nutrient estimates, Mitra’s answers, breathing and chanting practices, Surya Namaskar, step and water goals, is intended to diagnose, treat, cure, monitor or prevent any disease or condition, or to replace advice from a doctor, dietitian, or other qualified professional. No doctor–patient or other professional relationship is created by using the Service.

  • Talk to your doctor first before you change your diet, start a new exercise, breathing or fasting routine, or change any medicine, especially if you are pregnant or breastfeeding, are older, or have diabetes, high or low blood pressure, heart, lung, kidney or liver disease, an eating disorder, epilepsy, glaucoma, a recent surgery or injury, or take medicine for sugar, blood pressure, the heart, thyroid or blood thinning.
  • Physical practices carry risk. Surya Namaskar, walking and breathing practices (pranayama), including breath-holding and rapid breathing, can cause dizziness, fainting, falls, strain or injury, and may not be suitable for everyone. Practise on a safe, non-slip surface, within your own limits, and stop at once if you feel pain, dizziness, breathlessness, chest discomfort, numbness or unwell.
  • Be aware of your surroundings. Do not use the Step Tracker’s walk mode, or look at your phone, while crossing roads, driving, cycling or anywhere it is unsafe to be distracted.
  • Food and allergies. Meal plans and suggestions may not account for every allergy, intolerance, medical diet or interaction between food and medicine. Always check ingredients yourself. Do not rely on the Service to avoid allergens.
  • Water goals are general. Some medical conditions require you to limit fluids; follow your doctor’s advice over any goal shown in the Service.
  • Never ignore professional advice or delay seeking it because of something you read or heard in the Service.

In an emergency, call your local emergency number immediately (for example 911 in the US and Canada, 112 in Europe and India, 999 in the UK, 998 or 999 in the UAE, 000 in Australia). The Service cannot help in an emergency.

You choose whether and how to follow any practice or suggestion, and you take part in physical, breathing and dietary activities voluntarily and at your own risk, to the fullest extent the law allows.

5. AI features

Prana Plate, Mitra and Calorie Meter use artificial intelligence to estimate calories and nutrients from photos or descriptions, suggest meal plans and answer questions. You understand and agree that:

  • AI output is generated automatically, can be inaccurate, incomplete or out of date, and photo estimates can be off by 20% or more;
  • AI output is general information, not personal professional advice, and you should check anything important with a qualified professional;
  • you are responsible for what you enter, and you should not enter information about other people without their permission;
  • daily limits apply to keep the Service free and fair, and we may change them;
  • AI features depend on an outside provider and may be unavailable at times.

6. Financial wellbeing content

Content about money and financial wellbeing, such as money check-ins, is for general reflection and education only. It is not financial, investment, tax or legal advice, and it does not recommend buying or selling any investment. Consider speaking to a licensed professional before making financial decisions.

7. Acceptable use

You agree not to:

  • use the Service for anything unlawful, harmful or fraudulent, or in a way that infringes anyone’s rights;
  • upload images or text that are illegal, sexually explicit, hateful, violent, or that show or identify other people without their permission;
  • try to get around daily limits, the age requirement or other protections, for example by automating requests or using many device IDs;
  • use bots, scrapers or other automated means to access the Service, or copy or resell it or its AI features;
  • try to break, overload, probe or reverse-engineer the Service or its security, or interfere with other users;
  • use the Service to build a competing product, or to train or improve any AI model;
  • pretend to be someone else, or misrepresent your affiliation with us.

We may limit, suspend or block access for anyone who breaks these rules or puts the Service or others at risk.

8. Our content and your content

Our content. The Service and everything in it, including text, audio, videos, designs, the 108 Pranayama name and logo, badges, graphics and software, belongs to Shri Anand LLC or its licensors and is protected by copyright, trademark and other laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial wellbeing. You may share the badges you earn, our promo videos and links to our pages on social media and messaging apps, as long as you do not alter them or suggest we endorse you.

Your content. What you enter stays yours. You give us permission to process it only to provide the Service to you, as described in the Privacy Policy. If you send us feedback or ideas, you agree that we may use them to improve the Service without any obligation to you.

Copyright concerns. If you believe something in the Service infringes your copyright, please contact us with the details listed in section 18 and we will respond promptly.

9. Third-party services and links

The Service relies on and links to services run by others, such as our hosting, AI and statistics providers, browser push services, and apps such as WhatsApp and Instagram that you may choose to share with. We are not responsible for their content, availability, or practices, and your use of them is governed by their own terms.

10. Free service, changes and availability

The Service is currently free. We may add, change, limit or remove features, or stop the Service, at any time, with or without notice. Reminders and notifications depend on your device, browser and settings and may arrive late or not at all. Because your data is stored on your device, we cannot recover it if it is lost; please keep a backup using the backup options in My Sadhana and Prana Plate. If we ever introduce paid features, we will show their price and terms before you pay.

11. No warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the Service will be uninterrupted, secure or free of errors or harmful components. We do not warrant any health, fitness, weight, nutritional, spiritual or financial result.

12. Limitation of liability

To the fullest extent permitted by law:

  • Shri Anand LLC and its members, managers, employees, contractors and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising from or related to the Service or these Terms, even if we were told such damages were possible;
  • we will not be liable for any illness, injury or loss resulting from your decision to follow, or not follow, any information, estimate, practice or suggestion in the Service, or from relying on the Service instead of professional advice;
  • our total liability for all claims relating to the Service or these Terms is limited to the greater of (a) the amount you paid us to use the Service in the 12 months before the claim, or (b) US $100.

These limits apply whatever the legal theory (contract, tort including negligence, strict liability or otherwise). Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by our negligence, for fraud, or for gross negligence or wilful misconduct where the law does not allow it, and nothing affects rights you have as a consumer that cannot be waived.

13. Your responsibility to us

To the extent permitted by law, you agree to defend, indemnify and hold harmless Shri Anand LLC and its members, managers, employees and contractors from claims, damages, losses and expenses (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of others. This section does not apply to consumers where local law does not allow it.

14. Governing law and courts

These Terms are governed by the laws of the Commonwealth of Massachusetts and the federal laws of the United States, without regard to conflict-of-law rules. Subject to section 15 and section 16, any dispute that is not arbitrated will be brought only in the state or federal courts located in Middlesex County, Massachusetts, and you and we consent to their jurisdiction.

15. Arbitration and class action waiver (United States)

This section applies if you live in the United States. Please read it carefully; it affects your rights.

  • Talk to us first. Before starting any claim, you agree to email us a short description of the dispute and what you want, and to try in good faith to resolve it for at least 60 days.
  • Individual arbitration. If we cannot resolve it, you and we agree that any dispute arising from or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitration may be held by video or phone, or in the county where you live. If your claim is for US $10,000 or less, we will pay the AAA filing, administration and arbitrator fees, unless the arbitrator finds the claim frivolous.
  • Exceptions. Either of us may bring an individual claim in small claims court, and either of us may ask a court to stop infringement or misuse of intellectual property.
  • No class actions. You and we each agree to bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not combine claims of more than one person. If this class waiver is found unenforceable for a claim, that claim must be decided by a court, not in arbitration.
  • No jury. To the extent permitted by law, you and we waive any right to a jury trial.
  • 30-day right to opt out. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms, with the subject “Arbitration opt-out” and your device ID from the Privacy Policy page. Opting out does not affect any other part of these Terms.
  • Time limit. To the extent permitted by law, any claim must be brought within one year after it arose, or it is permanently barred.

16. If you live outside the United States

Section 15 does not apply to you. If you are a consumer in the European Union, the United Kingdom, India, or any other country whose laws give you rights that cannot be changed by contract, nothing in these Terms takes those rights away. In particular:

  • you keep the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in the courts of that country;
  • the disclaimers and limits in sections 11 to 13 apply only to the extent your local law allows;
  • in the EU, you may also use the EU’s online dispute resolution information at consumer-redress.ec.europa.eu; in India, you may approach the consumer commissions under the Consumer Protection Act, 2019.

17. General terms

  • Changes to these Terms. We may update these Terms. If a change matters, we will ask you to accept the new version the next time you open the Service. If you do not accept, please stop using the Service. Changes do not apply to disputes we already know about.
  • Ending. You may stop using the Service at any time and erase your data from the Privacy Policy page. Sections 4, 5, 8 and 11 to 17 continue to apply after you stop.
  • Severability. If any part of these Terms is found unenforceable, it will be enforced as far as possible, and the rest stays in effect.
  • No waiver. If we do not enforce a right, we have not given it up.
  • Assignment. You may not transfer these Terms. We may transfer them as part of a merger, acquisition or sale of assets.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
  • Language. These Terms are written in English. If we provide a translation, the English version applies where the law allows.
